Tigolapse Gizlilik Politikası ve KVKK Aydınlatma Metni

Bu metin, Tigolapse mobil uygulaması (Google Play paket adı com.sargem.appv3) ve uygulamanın bağlandığı sargem.app hizmetleri için 6698 sayılı Kişisel Verilerin Korunması Kanunu (KVKK) ve, uygulandığı ölçüde, AB Genel Veri Koruma Tüzüğü (GDPR) kapsamında hazırlanmıştır.

2. İşlediğimiz veriler

a) Hesap bilgileri: Sargem’in veya firmanızın yetkilisinin sizin için oluşturduğu hesaptaki ad-soyad, e-posta adresi, varsa telefon numarası, firma adı, kullanıcı numarası ve parola. Parolalar sunucuda özetlenerek (hash) saklanır. Parolanız ne açık hâliyle ne de özet olarak cihazınızda saklanmaz.

b) Oturum ve kullanım kayıtları: Her girişte oluşturulan uygulama erişim anahtarı, son giriş ve son uygulama isteği zamanları; sunucu ve ağ altyapısının güvenlik amacıyla tuttuğu IP adresi ve istek zamanı gibi teknik kayıtlar.

c) Talepleriniz: Uygulamadan gönderdiğiniz sorun bildirimleri (konu, yazdığınız e-posta veya telefon numarası, mesaj), video talepleri (kamera ve tarih-saat aralığı), özel video talepleri (kamera, süre, e-posta ve not) ve toplu indirme talepleri (kamera ve tarih-saat aralığı).

d) Şantiye görüntüleri: Sargem’in müşteri projelerine kurduğu kameraların çektiği fotoğraflar ve bunlardan üretilen videolar. Uygulama yalnızca hesabınızın yetkilendirildiği projelerin kameralarını listeler. Görüntülerde şantiyedeki kişiler, araçlar veya plakalar tesadüfen yer alabilir.

Toplamadığımız veriler: konum, rehber, telefonunuzun kamerası veya galerinizdeki fotoğraflar, cihaz kimlikleri ve reklam kimliği. Uygulamada reklam, analiz (analytics) veya hata raporlama araçları bulunmaz.

3. Cihazınızda saklanan veriler

  • Oturumunuzu açık tutmak için giriş durumu, kullanıcı numarası, e-posta adresi, firma adı ve erişim anahtarı uygulamaya özel depolama alanında saklanır. Daha hızlı açılış için sunucudan alınan kamera, video ve toplu indirme listeleri de aynı alanda önbelleğe alınır. Bu listelerde proje ve kamera adlarının yanında hesabınıza ait ad-soyad ve firma bilgileri bulunabilir.
  • “Çıkış Yap” bu verileri cihazdan siler; yalnızca oturumun kapalı olduğu bilgisi kalır. Oturumunuz sunucu tarafından sonlandırılırsa (örneğin parolanız sıfırlandığında) uygulama erişim anahtarını ve önbelleğe alınmış listeleri kendisi siler. Uygulamanın bütün verilerini silmek için uygulamayı kaldırın veya Android Ayarlar > Uygulamalar > Tigolapse > Depolama > Verileri temizle adımını kullanın.
  • İndirdiğiniz fotoğraf ve videolar cihazınızın “Pictures/tigolapse” klasörüne kaydedilir. Paylaştığınız fotoğrafın bir kopyası cihazınızın galerisine eklenir. Bu dosyalar siz silene kadar cihazınızda kalır.

4. İşleme amaçları ve hukuki sebepler

  • Kimliğinizi doğrulamak, oturum açmak, yetkili olduğunuz kamera görüntülerini göstermek, video ve toplu indirme taleplerinizi hazırlamak: sözleşmenin kurulması ve ifası (KVKK m.5/2-c; GDPR m.6/1-b).
  • Sorun bildirimlerinize ve taleplerinize yanıt vermek, sizinle iletişim kurmak: sözleşmenin ifası ve meşru menfaat (KVKK m.5/2-c ve m.5/2-f; GDPR m.6/1-b ve m.6/1-f).
  • Hizmet güvenliğini sağlamak, kötüye kullanımı önlemek, hesap etkinliğini izlemek: meşru menfaat (KVKK m.5/2-f; GDPR m.6/1-f).
  • Hizmetlerin faturalandırılması ve yasal kayıt yükümlülükleri: hukuki yükümlülük (KVKK m.5/2-ç; GDPR m.6/1-c).

Verilerinizi reklam, profilleme veya satış amacıyla kullanmayız.

5. Aktarımlar

Verilerinizi satmayız ve reklam amacıyla kimseyle paylaşmayız. Hizmeti sunmak için veriler şu taraflara aktarılır:

  • Sunucu barındırma: Netvia Bilişim Yazılım Danışmanlık Tic. Ltd. Şti. (Türkiye): sargem.app ve görüntülerin sunulduğu media.tigotr2.com sunucuları. Hetzner Online GmbH (Almanya): kamera fotoğraflarının orijinallerinin saklandığı arşiv sunucusu. Bu sağlayıcılar verileri bizim adımıza ve talimatımızla işler.
  • E-posta gönderimi: Şifre belirleme ve bildirim mailleri Peradesk e-posta gönderim hizmeti üzerinden gönderilir. Bu hizmet e-posta adresinizi ve mailin içeriğini bizim adımıza işler.
  • Cloudflare, Inc. (ABD): sargem.app ve sargem.com.tr için ağ, içerik dağıtımı ve güvenlik hizmeti. Bu kapsamda IP adresi ve istek bilgileri bizim adımıza işlenir.
  • Telegram: Sorun bildirimleri ile video ve toplu indirme talepleri, ekibimize iç bildirim olarak Telegram mesajlaşma hizmeti üzerinden iletilir. Bildirimde ad-soyadınız, kullanıcı numaranız, talebin içeriği ve varsa yazdığınız e-posta veya telefon bulunur. Telegram, bu mesajları kendi hizmet koşulları ve gizlilik politikası çerçevesinde işleyen üçüncü taraf bir mesajlaşma hizmetidir.
  • Firmanız: Hesabınız müşteri firmanız adına açıldığından, firmanızın yetkilileri kullanıcı hesaplarını ve hangi projelere erişilebileceğini yönetebilir.
  • Yetkili kamu kurum ve kuruluşları: yalnızca kanunen zorunlu hâllerde.

Cloudflare, Hetzner ve Telegram’a yapılan aktarımlar yurt dışına aktarım niteliğindedir ve KVKK m.9 kapsamında [DAYANAK: ör. standart sözleşme ve Kurul’a bildirim — hukuki inceleme] ile yapılır.

Uygulamadaki “WhatsApp Destek” bağlantısı WhatsApp’ı açar; bu yazışma WhatsApp’ın kendi gizlilik politikasına tabidir. “Hakkımızda” bağlantısı sargem.com.tr‘yi tarayıcınızda açar.

6. Şantiye görüntüleri

Kameralar, müşterilerimizle yaptığımız sözleşmeler kapsamında müşterinin şantiyesine kurulur. Görüntüler şantiyenin ilerleyişini belgelemek için çekilir ve kişileri tanımlamak amacı taşımaz. Bu görüntüler bakımından Sargem, müşteriyle yaptığı sözleşme çerçevesinde [veri işleyen / veri sorumlusu — hukuki inceleme] olarak hareket eder. Bir görüntüde yer aldığınızı düşünüyorsanız aşağıdaki iletişim adresinden bize başvurabilirsiniz.

7. Saklama süreleri

  • Hesap bilgileri: hesabınız açık kaldığı sürece; hesap kapatıldıktan sonra [30 gün] içinde silinir veya anonim hâle getirilir.
  • Sorun bildirimleri ve talepler: [2 yıl].
  • Sunucu ve ağ kayıtları: [90 gün].
  • Telegram bildirimleri: [SÜRE] sonra sohbetten silinir.
  • Ticari ve fatura kayıtları: ilgili mevzuatın öngördüğü süre boyunca (Türk Ticaret Kanunu ve Vergi Usul Kanunu kapsamında [10 yıla kadar]).
  • Şantiye görüntüleri: müşteri sözleşmesinin süresi ve sözleşmede belirtilen ek süre boyunca.

8. Güvenlik

Uygulama ile sunucularımız arasındaki tüm iletişim HTTPS ile şifrelenir. Parolalar sunucuda özetlenerek saklanır.

9. Haklarınız

KVKK m.11 uyarınca verilerinizin işlenip işlenmediğini öğrenme, bilgi talep etme, işleme amacını ve amaca uygun kullanılıp kullanılmadığını öğrenme, aktarıldığı üçüncü kişileri bilme, düzeltilmesini, silinmesini veya yok edilmesini ve bunun aktarılan kişilere bildirilmesini isteme, otomatik analiz sonucu aleyhinize çıkan sonuca itiraz etme ve zararınızın giderilmesini talep etme haklarına sahipsiniz. GDPR kapsamındaysanız erişim, düzeltme, silme, kısıtlama, veri taşınabilirliği ve itiraz haklarına da sahipsiniz.

Başvurunuzu kayıtlı e-posta adresinizden info@sargem.com.tr adresine gönderebilir veya yukarıdaki adrese yazılı olarak iletebilirsiniz. Başvurunuzu en geç 30 gün içinde ücretsiz olarak sonuçlandırırız. Kişisel Verileri Koruma Kurulu’na veya bulunduğunuz ülkedeki veri koruma otoritesine şikâyette bulunma hakkınız saklıdır.

10. Hesabınızın ve verilerinizin silinmesi

Tigolapse uygulamasında hesap oluşturulamaz; hesaplar Sargem veya firmanızın yetkilisi tarafından açılır. Hesabınızın ve ilişkili verilerinizin silinmesini istemek için kayıtlı e-posta adresinizden info@sargem.com.tr adresine “Hesap silme talebi” konulu bir e-posta gönderin. E-postada uygulamanın adını (Tigolapse) ve firma adınızı belirtin. Firmanızın yetkilisi hesabınızı sargem.app üzerinden devre dışı bırakabilir; verilerinizin silinmesi için yine bu yolla başvurun.

Talebiniz en geç 30 gün içinde sonuçlandırılır. Ad-soyad, e-posta, telefon, parola, erişim anahtarları, proje yetkileri, sorun bildirimleri ve talepleriniz silinir veya anonim hâle getirilir. Şantiye görüntüleri firmanızın sözleşmesine ait olduğundan sözleşme süresince saklanır. Yasal saklama yükümlülüğü olan ticari kayıtlar ilgili süre boyunca tutulur. Cihazınızdaki verileri silmek için uygulamayı kaldırın.

11. Çocuklar

Tigolapse iş amaçlı bir uygulamadır ve 18 yaşından küçüklere yönelik değildir. Çocuklardan bilerek veri toplamayız.

12. Değişiklikler

Bu metni güncelleyebiliriz. Güncel sürüm bu sayfada yayımlanır ve “Son güncelleme” tarihi değiştirilir.

This policy covers the Tigolapse mobile app (Google Play package com.sargem.appv3) and the sargem.app services it connects to. It is prepared under the Turkish Personal Data Protection Law No. 6698 (KVKK) and, where applicable, the EU General Data Protection Regulation (GDPR).

2. Data we process

a) Account data: the name, e-mail address, phone number (if any), company name, user number and password of the account that Sargem or your company administrator creates for you. Passwords are stored hashed on the server. Your password is not stored on your device, either in plain text or hashed.

b) Session and usage records: the app access key issued at each login, the time of your last login and last app request, and technical records such as IP address and request time kept by our server and network infrastructure for security.

c) Your requests: problem reports you send from the app (subject, the e-mail or phone number you enter, message), video requests (camera and date-time range), custom video requests (camera, duration, e-mail and note) and bulk download requests (camera and date-time range).

d) Construction site images: photos taken by the cameras Sargem installs on customer projects, and videos made from them. The app only lists cameras of the projects your account is authorised for. People, vehicles or licence plates on the site may appear incidentally.

We do not collect: location, contacts, your phone’s camera or the photos in your gallery, device identifiers or the advertising ID. The app contains no advertising, analytics or crash-reporting tools.

3. Data stored on your device

  • To keep you signed in, the app stores your login status, user number, e-mail address, company name and access key in the app’s private storage. For faster start-up, the camera, video and bulk download lists received from the server are cached in the same place. Besides project and camera names, these lists may contain your name and company details.
  • “Çıkış Yap” (Log out) deletes this data from your device; only the fact that you are signed out is kept. If the server ends your session (for example when your password is reset), the app deletes the access key and the cached lists itself. To remove all app data, uninstall the app or use Android Settings > Apps > Tigolapse > Storage > Clear data.
  • Photos and videos you download are saved to the “Pictures/tigolapse” folder on your device. When you share a photo, a copy is added to your device’s gallery. These files stay on your device until you delete them.

4. Purposes and legal bases

  • Authenticating you, signing you in, showing the camera images you are authorised for, and preparing your video and bulk download requests: performance of a contract (KVKK Art. 5/2-c; GDPR Art. 6(1)(b)).
  • Answering your problem reports and requests and contacting you: performance of a contract and legitimate interest (KVKK Art. 5/2-c and 5/2-f; GDPR Art. 6(1)(b) and (f)).
  • Keeping the service secure, preventing misuse and monitoring account activity: legitimate interest (KVKK Art. 5/2-f; GDPR Art. 6(1)(f)).
  • Invoicing services and statutory record keeping: legal obligation (KVKK Art. 5/2-ç; GDPR Art. 6(1)(c)).

We do not use your data for advertising, profiling or sale.

5. Recipients

We do not sell your data or share it for advertising. To provide the service, data is transferred to:

  • Server hosting: Netvia Bilişim Yazılım Danışmanlık Tic. Ltd. Şti. (Türkiye), for sargem.app and the media.tigotr2.com servers that deliver the images; Hetzner Online GmbH (Germany), for the archive server that stores the original camera photos. These providers process data on our behalf and on our instructions.
  • E-mail delivery: password-setup and notification e-mails are sent through the Peradesk e-mail delivery service, which processes your e-mail address and the content of the e-mail on our behalf.
  • Cloudflare, Inc. (USA): network, content delivery and security for sargem.app and sargem.com.tr. IP addresses and request data are processed on our behalf for this purpose.
  • Telegram: problem reports and video and bulk download requests are forwarded to our team as internal notifications via the Telegram messaging service. A notification contains your name, user number, the content of the request and, if you entered them, your e-mail or phone number. Telegram is a third-party messaging service that processes these messages under its own terms of service and privacy policy.
  • Your company: because your account is opened on behalf of your company, your company’s administrators can manage user accounts and which projects users can access.
  • Competent public authorities: only where required by law.

Transfers to Cloudflare, Hetzner and Telegram are transfers abroad and are made under KVKK Art. 9 on the basis of [BASIS: e.g. standard contract and notification to the Board — legal review].

The “WhatsApp Destek” link in the app opens WhatsApp; that conversation is subject to WhatsApp’s own privacy policy. The “Hakkımızda” (About) link opens sargem.com.tr in your browser.

6. Construction site images

Cameras are installed on the customer’s site under our contracts with customers. Images are taken to document the progress of the site and are not intended to identify people. For these images Sargem acts as [processor / controller — legal review] under its contract with the customer. If you believe you appear in an image, you can contact us at the address below.

7. Retention

  • Account data: while your account is open; deleted or anonymised within [30 days] after the account is closed.
  • Problem reports and requests: [2 years].
  • Server and network logs: [90 days].
  • Telegram notifications: deleted from the chat after [PERIOD].
  • Commercial and invoice records: for the period required by law (up to [10 years] under the Turkish Commercial Code and Tax Procedure Law).
  • Construction site images: for the term of the customer contract plus any period stated in it.

8. Security

All communication between the app and our servers is encrypted with HTTPS. Passwords are stored hashed on the server.

9. Your rights

Under KVKK Art. 11 you may learn whether your data is processed, request information about it, learn the purpose of processing and whether data is used accordingly, know the third parties it is transferred to, request correction, deletion or destruction and notification of these to recipients, object to a result against you arising from automated analysis, and claim compensation for damage. If the GDPR applies to you, you also have the rights of access, rectification, erasure, restriction, data portability and objection.

Send your request from your registered e-mail address to info@sargem.com.tr, or in writing to the address above. We respond free of charge within 30 days at the latest. You may also complain to the Turkish Personal Data Protection Authority or to the data protection authority in your country.

10. Deleting your account and data

Accounts cannot be created in the Tigolapse app; Sargem or your company administrator creates them. To request deletion of your account and associated data, send an e-mail with the subject “Hesap silme talebi” (account deletion request) from your registered e-mail address to info@sargem.com.tr. Please state the app name (Tigolapse) and your company name. Your company administrator can deactivate your account on sargem.app; to have your data deleted, use the e-mail request above.

We complete requests within 30 days. Your name, e-mail, phone number, password, access keys, project permissions, problem reports and requests are deleted or anonymised. Construction site images belong to your company’s contract and are kept for its term. Commercial records subject to statutory retention are kept for the required period. To remove data from your device, uninstall the app.

11. Children

Tigolapse is a business app and is not directed at anyone under 18. We do not knowingly collect data from children.

12. Changes

We may update this policy. The current version is published on this page with an updated “Last updated” date.
